Who plagiarized whom?

So, there's some stuff happening in blogland these days. A person named Amanda claiming an epublished author JJ Massa plagarized her work, Another Time, Another Place, retitled the work and had it published...twice.

You can read side-by-side excerpts from both the fanfic piece by Amanda and the published book by Massa on This Blog. If you check the comments, you'll find Amanda's comment a few down from the top.

I'm in no position to say (or even guess) who is the plagiarizer and who is the plagiarizee (probably not real words, but you get my drift). But I will say the excerpts are similar enough to convince me there's something shady going on. Either way, it's very sad that someone felt they needed to borrow another's work and pass it off as their own.

How will this end? We'll have to wait and see. Amanda claims she's taking the issue to court. And that may happen. But call me a cynic, I doubt anything will come of it. From what I can see, the work was fanfiction. It cannot be sold and therefore I can't see her suffering any financial damages. I'm no lawyer, but from what I understand, if she did not file a copyright (highly unlikely, although not necessary), there are limits to what she can expect to receive, even if she wins a court case.

Why should I register my work if copyright protection is automatic?
Registration is recommended for a number of reasons. Many choose to register their works because they wish to have the facts of their copyright on the public record and have a certificate of registration. Registered works may be eligible for statutory damages and attorney's fees in successful litigation. Finally, if registration occurs within 5 years of publication, it is considered prima facie evidence in a court of law. See Circular 1, Copyright Basics, section “Copyright Registration” and Circular 38b, Highlights of Copyright Amendments Contained in the Uruguay Round Agreements Act (URAA), on non-U.S. works.

Copyright Registration

In general, copyright registration is a legal formality intended to make a public record of the basic facts of a particular copyright. However, registration is not a condition of copyright protection. Even though registration is not a requirement for protection, the copyright law provides several inducements or advantages to encourage copyright owners to make registration. Among these advantages are the following:

  • Registration establishes a public record of the copyright claim.
  • Before an infringement suit may be filed in court, registration is necessary for works of U.S. origin.
  • If made before or within 5 years of publication, registration will establish prima facie evidence in court of the validity of the copyright and of the facts stated in the certificate.
  • If registration is made within 3 months after publication of the work or prior to an infringement of the work, statutory damages and attorney's fees will be available to the copyright owner in court actions. Otherwise, only an award of actual damages and profits is available to the copyright owner. (boldface added by moi)
  • Registration allows the owner of the copyright to record the registration with the U. S. Customs Service for protection against the importation of infringing copies. For additional information, go to the U.S. Customs and Border Protection website at Click on “Intellectual Property Rights.”

Registration may be made at any time within the life of the copyright. Unlike the law before 1978, when a work has been registered in unpublished form, it is not necessary to make another registration when the work becomes published, although the copyright owner may register the published edition, if desired.

The Day After

I hope everyone had a terrific holiday yesterday, and for those who braved the stores/malls today, I hope you survived...and scored some great deals.

Me, I stayed home, to write. I have a book due at the end of next week and need to stay focused. But luckily, I've done a lot of my Christmas shopping already. For those who didn't know, Amazon has free shipping for most toys right now. No crowds. No lines. And GREAT prices. They're beating everyone, including Walmart, on most things.

You know what, there was a time when I wasn't liking the way Amazon was offering toys shipped from third-party vendors, but it's working out a lot better than I thought. I'm finding great deals and the vendors I've purchased from have shipped faster than Amazon. Terrific service.

Tomorrow, I'm heading back to Another Look Books in Taylor for a book signing (3:00 pm until 5:00). This will be the first signing I'll have with my new Ellora's Cave print release, Immortal Secrets (yay!). Wish me luck. The store wants me to read an excerpt (ack!). I'm going to be inserting a lot of *bleeps* for naughty words, LOL.

The Bachelor Season Finale

Usually, I post about writing stuff, submissions, craft, whatever. This time, I wanted to do something different. Let's talk about one of my fave reality shows--The Bachelor.

I don't know how many of you watch The Bachelor, but I'm not ashamed to admit, I'm an addict. If you've watched former seasons, you know how this thing is supposed to work. There's a bachelor, who is financially stable, attractive, successful (relative term) and there are twenty five bachelorettes for him to weed through in his quest for true love.

This season's bachelor was bar owner and entrepreneur Brad Womack and he was down to two girls, a Pheonix Suns dancer and a real estate agent and bartender. Both girls told him they were falling in love with him.

Now, in past seasons, it went something like this: Girls tell the bachelor they love him. Bachelor chooses the wrong one (in my opinion), he proposes, they try to make it work long distance, make a few public appearances, and then a few months later the bachelor is spotted getting snuggly with a Miss Universe contestant. Let's just say the success rate for romances spawned on the show isn't great.

So, this season, it seemed Brad Womack decided to go a different route...


Brad didn't chose EITHER bachelorette. They were both sent home ringless and roseless. And you know what? If Brad did that for the reason he stated (Saying I love you is a big commitment and I'm not ready to make that kind of promise to you. I care too much for you to do that.) then I REALLY respect him, and just maybe this bachelor was on the show for the right reason--because he was hoping he'd find the love of his life. If you watch his face as the girls are pouring out their hearts to him, it gets red, tense. You can tell something is VERY wrong, bothering him something fierce. I think it was killing him, not being able to tell the girls exactly how he felt. This guy was doing his best to be for real. At least, that's what I see.

Anyone else have an opinion? What do you think? Lying jerk? Or a guy trying to do what is right?

Sounds great, doesn't it? You want one, don't you? I know I was curious after reading this. Wireless, no syncing needed. That sounds great. No searching for wireless hotspots. No monthly access fees. Adjustable text size and long battery life. Great!

And then I took a closer look.

The screen is black and white. And no graphics. (Is this true?!)
The price is crazy ($399!)
Reportedly, you may only read ebooks compatible with the reader, which means no pdf's, or other formats. (Cannot verify if this is true or not)
No touchscreen.
What happens when it becomes obsolete?
And did I mention the price?!

I don't know. I'm thinking Team Kindle may need to head back to the drawing board. Now, if I could buy this for $100...that would be an entirely different thing.

'Twas the Monday before Thanksgiving and all through the house...

How are you all doing with your Thanksgiving preparations? Ready for The Big Day? Or will you wait until Wednesday to shop?

Me, I've spent the past two weekends preparing, and we're not even having any company. It'll be a quiet day spent at home. But I wanted the right mood...which means the Christmas decorations had to be put up. Yes, I have not one but two Christmas trees up in my home already. Although one is only wearing lights at the moment. And feeling a little nekkid. I have pretty green garland draped over my enormous doorwall and more over the fireplace. It all looks so warm and cozy and inviting.

I also bought all the food for Thursday. The turkey's defrosting in the fridge. My work is just about done. I feel like I've accomplished so much. Ahhhh.

The best part about this year--my husband has promised to do ALL the cooking AND cleaning that day. What a switch. For the past ten years, it's been all me. I'm SO looking forward to sitting back, doing some reading, relaxing and eating myself into a coma.

An Informal Survey

Today I’m starting a new story. Whoo hooo! Beginning a new book is a thrilling challenge. There’s a new set of characters to meet, a new story to discover.

Every author has his or her unique system for starting a new project. But for me, I start with a title and a synopsis. Why? Because the title sets the tone for the story. And the synopsis gives me a rough framework to build upon as I write.

So what is this survey I was talking about? It’s regarding titles. Lately, it seems that cute titles like clever twists on common expressions or clichés are pretty much out... and sexy, grittier titles are all the rage.

Opinions anyone? I’d be so grateful if you’d give me examples of your favorites (or least favorites) in the comments. I need inspiration. A good title can make a HUGE difference in the success of a story.

Yet Another EPublisher Closes

Good afternoon,

As a few of you know already I've been out with a family emergency.
Unfortunately, I have to make a change in priorities in my life at the
moment and my family comes first.

It is with deep regret that I must close the doors to Chippewa
Publishing LLC and Lady Aibell Press. I would like to thank all of you
for sharing your wonderful stories with the company and our readers
and giving us the opportunity to publish them.

All rights will be returned to the authors on November 30, 2007. This
will give me time to remove the books from the shelves as it isn't an
overnight process. Please remember that even though books are removed
from the e-shelves that I do not receive immediate payment from the
wholesalers. Royalties will continue to be paid until all payments are
sent by the distributors and they owe no more. Sometimes this can take
up to a year to be paid. If you do see your books at any of our
distributors after November 30, 2007, please tell me immediately so I
can demand they're removed from the site.

I will be happy to write a letter of release to any future publisher
you choose for your story. I will not have dedicated computer access
until the end of November, but I can send letters through my assistant

I've enjoyed working with all of you and I appreciate the time and
commitment you have given to me and the company. I wish you luck in
all your writing adventures. Please keep me posted on new releases
that you have as I will need to buy more books to read in the future.

Authors, it is in your best interest to carefully choose which publishers you submit to. Contact authors published by the house. Check resources like Preditors and Editors and Piers Anthony. Sometimes it's very difficult to get a solid handle on a prospective publisher's financial stability. Just understand that there's always a risk of things going sour. Have a backup plan. Spread your work around. And be particularly cautious with new epublishers.

TGIF and Two Great Reviews

TGIF! And happy birthday to my hubby!

This morning, I received a couple of really great surprises in my email box...and it's not even my birthday :) What were these gifts? Two terrific new reviews for my Changeling Press books, Obsidian Mirror and If Looks Could Kill. A BIG thank you to both reviewers!

Review of Obsidian Mirror

Right from the beginning, _Obsidian Mirror_ drew me in. The author's
straight-up and sassy narrative brings life to her characters and the
story. Skylar is a tortured soul, wounded by a horrific childhood, but
she never lapses into self-pity. Skylar is vulnerable but not wimpy or
whinny and I love the way she embraces her need for dominance. While I
enjoyed the sexy and dominant Trace, I wanted to know more about him and
wished the author could have explored him in more depth. Still, Trace is
a strong man that any woman would want in her bed. Just like Skylar,
Trace embraces his need to dominate even though it springs from dark
place. I don't want to give anything away, but I think readers will
appreciate both characters reasons for their sexual needs. Ms. Taylor
has written an engaging short story that just grabbed me and didn't let
go until the last page. The sex scenes were hot, detailed, and
definitely arousing. The sex was so enticing that I found myself wanting
more of Skylar's need for dominance and Trace's need to provide it.
Overall, I recommend _Obsidian Mirror_ for readers who enjoy stories
that have a bit rougher sex without over-the-top brutality.

Review of If Looks Could Kill (Carpe Nocturne 3)

Tawny Taylor has written a nice finale to the love triangle of Burke, Sylvie and Miko. The shocking twist at the end, who was behind everything, including the framing of Burke, took me by surprise. I also liked the insight into Sylvie’s past and why she needs the love of these two men. The idea of two men bringing such happiness to a lonely woman’s life makes IF LOOKS COULD KILL a wonderful love story. Sylvie is a woman after my own heart.

More intoxicating scents swept into his nostrils as he nuzzled the crook between her shoulder and the slender column of her neck.

She shrieked again and then went dead still.

Asher had bitten her. His venom was pulsing through her blood vessels. It would take less than ten seconds.

He ran his tongue along her jugular. Her heartbeat fluttered beneath her skin, a staccato tempo that beat within him.

Are you shopping for an Ebook Reader?

If so, you may want to check out THIS POST on They are comparing several brands of ebook readers, including at least one e-ink model.

BTW, when I'm asked to give an opinion on this topic, I recommend a palm computer. There's very little difference in cost between a palm computer (such as a Dell Axim, which is what I own) and many of the dedicated ebook readers (like the Sony). I prefer the multi-use functionality of the palm versus the single use of a reader.
